Essential clarification regarding payments
The amount paid to register for a charitable competition is a participation contribution to the Event, not an independent donation. The rule on refunding donations made in error applies exclusively to independent donations and cannot be invoked by a participant to obtain a refund of the participation contribution after the registration has been confirmed or after taking part in the competition.
1. Identification of the Association and acceptance of the terms and conditions
These terms of use and participation (the “Terms”) govern the access to and use of the website https://sportforgood.ro/ (the “Site”), as well as the registration and participation in the charitable sporting events organized by The Social Incubator Association (“ATSI” or the “Organizer”).
The Platform has an informative and operational role: it presents the Sport for Good projects and events, allows registration requests to be submitted, and provides access to the details, schedule, regulations, logistical information, and ways to support the social cause associated with each Event.
By accessing the Platform, submitting a registration form, paying a participation contribution, or making a donation through the displayed links, the User confirms that they have read, understood, and accept the Terms in force at the time of use. If they do not agree with them, the User must stop using the Platform and must not complete the registration or the payment.
The Terms are supplemented by the Regulations specific to each Event, the Privacy Policy, the Cookie Policy, and, where applicable, the information displayed in the payment flow. In the event of any inconsistency, the Event’s specific Regulations and the clear information displayed for the respective edition shall prevail for matters specific to that Event.
2. Definitions
- “User” means any person who visits or uses the Platform.
- “Participant” means the individual registered or designated by a company to take part in an Event.
- “Team representative” means the person who submits the registration on behalf of a company or a team and who confirms the accuracy of the data provided.
- “Event” means any tournament, competition, sporting activity, related action, or edition organized under the Sport for Good brand.
- “Participation contribution” means the amount paid to register for an Event, which grants access to participation and supports the social cause communicated for that Event.
- “Independent donation” means an amount offered voluntarily, without being associated with the registration, participation, or access to an Event.
3. Use of the Platform
The User has the right to access the Platform exclusively for personal, informative purposes, or to register for the promoted Events. The User is responsible for the equipment, internet connection, and security measures necessary to access the Platform.
It is prohibited to use the Platform for illegal, fraudulent, defamatory, abusive, unauthorized commercial activities, or for any action that may affect the operation of the Platform, the security of the systems, ATSI’s reputation, the rights of partners, or the experience of other Users.
- attempting to gain unauthorized access to data, accounts, systems, or functionalities;
- transmitting malicious code, viruses, spam, or unsolicited messages;
- copying, extracting, or reusing the Platform’s content for commercial purposes, without ATSI’s prior written consent;
- providing false or incomplete data, or data belonging to other persons without the right to do so.
ATSI may limit or suspend the access of a User who breaches the Terms or the applicable legislation, without affecting ATSI’s right to seek compensation for the damages caused.
4. Registration and participation conditions
Registration for an Event is carried out by following the steps indicated on the page of the respective edition and is considered confirmed only after the conditions communicated by the Organizer have been met, including confirmation of availability, verification of the data, and, where applicable, confirmation of payment.
The person submitting the registration form declares that the data provided is true, complete, and up to date. When the registration is carried out by a representative of a company or a team, they confirm that they have the right to communicate the data of the designated participants and that they have informed them about the processing of their data in the context of the Event.
The eligibility conditions, minimum age, team composition, required documents, schedule, sporting rules, and any specific requirements are those established by the Event Regulations. Participants must comply with the instructions of the Organizer, the referees, the medical staff, and the venue representatives.
ATSI may refuse, cancel, or update a registration in the event of sold-out places, non-confirmation of payment, incomplete or incorrect data, failure to meet the eligibility conditions, or breach of the Terms or the Regulations. Where the Organizer is unable to confirm participation after receiving the contribution for reasons attributable to the Organizer, the amount will be refunded in accordance with Section 5.6, unless the payer expressly requests that it be converted into an independent donation.
5. Participation contribution, cancellations, and refunds
5.1. Nature of the participation contribution
The amounts displayed for each Event are expressed in the currency and under the conditions communicated on the registration page. The participation contribution is paid for reserving a place and taking part in the Event, including, where applicable, the organizational elements communicated by the Organizer. The Events have a charitable purpose, and the funds are used to support the programs of The Social Incubator Association dedicated to young people from vulnerable backgrounds.
The fact that the Event has a charitable purpose does not transform the participation contribution into an independent donation. The participation contribution remains distinct from donations made voluntarily, without access to or benefits related to participation.
5.2. Payment processing
To the extent that online payment is available for an Event, its processing is carried out through NETOPIA Payments, via a secure payment flow. The full card details are entered directly on the payment processor’s secure page; ATSI does not request or store the full card details.
A transaction is considered completed only after it has been authorized and confirmed by the payment processor and/or the issuing bank. In the event of a failed payment, a bank rejection, or a technical error, the registration is not confirmed until the situation has been clarified.
5.3. Cancellation of participation by the Participant
Participants may request the cancellation of their participation through a notice sent to [email protected], as a rule at least 5 (five) calendar days before the date of the Event. The request must include the name of the payer, the name of the company/team, the name of the Event, the date of payment, and contact details for verification.
In the event of the Participant’s withdrawal, the participation contribution is not refunded automatically, as the Organizer may already have incurred organizational costs for the Event. ATSI may approve, on a case-by-case basis, a full or partial refund of the contribution where the withdrawal is justified and does not cause harm to the Organizer, subject to any applicable mandatory rights.
The replacement of a participant or a team member may be requested before the Event, under the conditions and within the deadline established by the specific Regulations. Failure to show up for the Event, without prior notice and without the Organizer’s consent, does not give rise to the right to a refund of the participation contribution.
5.4. Special rule for competition participants
Special rule: The policy on refunding donations made in error, provided in Section 6, does not apply to the contribution paid to register for a charitable competition. A Participant cannot subsequently request a refund of the participation contribution by claiming that the payment was a donation made in error, in particular after the registration has been confirmed, the participation benefits have been used, or after actually taking part in the competition.
This rule does not limit the Participant’s right to report a genuine technical error, a duplicate payment, or an unauthorized payment, which will be analyzed separately, based on the supporting documents and the rules applicable to the payment processor and the issuing bank.
5.5. Right of withdrawal for Events with a set date
To the extent that the rules on distance contracts with consumers apply, services related to leisure activities organized for a specific date or period may be subject to the exception from the right of withdrawal provided by the applicable legislation. This section does not affect the mandatory rights enjoyed by participants under the law.
5.6. Cancellation or modification of the Event by the Organizer
ATSI may modify the schedule, location, format, number of teams, the composition of the included services, or other logistical details of the Event when necessary for safety, legal compliance, weather conditions, venue availability, force majeure, or the proper conduct of the Event. Relevant changes will be communicated by e-mail and/or through the Platform.
If the Organizer cancels the Event and does not offer a rescheduling accepted by the payer, the participation contribution will be refunded within a maximum of 15 (fifteen) working days from the communication of the decision, through the initial payment method or, if this is not possible, by bank transfer. The contribution may be kept as an independent donation only with the express consent of the payer.
6. Independent donations and refunds of donations made in error
6.1. Independent donations
Persons who wish to support the social cause may make independent donations through the donation page of The Social Incubator Association, which is also accessible through the links displayed on the Platform. An independent donation is not conditional on registration or participation in an Event and does not grant the right of access, a participation kit, a reserved place, or other benefits specific to the Event.
Online donations may be one-time or recurring, depending on the options available in the donation flow. The donor must provide true, correct, and complete data. The amount displayed in RON represents the sum to be paid, without any other additional fees charged by ATSI.
6.2. Recurring donations
When the recurring donation option is available, the donor authorizes the periodic charging of the card, at the value and frequency selected in the donation flow. The donor may request the cancellation of the recurrence at any time, before the next charge, through the mechanism provided in the donation flow or through a request sent to [email protected].
Cancelling the recurrence takes effect for future charges and does not cancel donations already processed, except in situations where the donor submits a refund request under the terms of this Section 6.
6.3. Requesting a refund of a donation made in error
ATSI gives the donor the option to request a refund of an independent donation made in error. This covers, by way of example, situations of a duplicate payment, the erroneous selection of an amount, an unintended donation, or a technical error in the processing of the transaction.
For a one-time donation, the request must be submitted within a maximum of 30 (thirty) calendar days from the date the payment was processed. For a recurring donation, the donor may request the review and, where applicable, the refund of a maximum of 3 (three) previous monthly donations, provided that the request is submitted within a maximum of 30 (thirty) calendar days from the most recent charge.
The request is sent to [email protected] or by phone at +40 790 599 908 and must include:
- the donor’s first and last name or the name of the paying legal entity;
- the e-mail address and phone number used for the payment;
- the date, the approximate amount, and, if available, the transaction reference;
- an explanation of the error and any information reasonably necessary to identify the payment.
For the donor’s safety, the full card details, the CVV/CVC code, or authentication passwords must not be sent by e-mail. ATSI may request additional information strictly necessary to identify and verify the transaction.
After verifying the request, ATSI will initiate the refund within a maximum of 5 (five) working days. The actual crediting of the amount to the donor’s account may take up to 45 (forty-five) calendar days, depending on the issuing bank, the type of card, and the payment processor’s rules. The refund is generally made using the same payment method initially used.
Express exclusion: The refund mechanism in this Section does not apply to amounts paid as a participation contribution to an Event. In particular, it cannot be used by a person who has registered, received, or used participation benefits, or who has taken part in the charitable competition, and who subsequently requests a refund of the amount as a “donation made in error”.
6.4. Unauthorized or suspicious transactions
In the event that a payer suspects the unauthorized use of the card or fraud, they must immediately contact the card’s issuing bank and, in parallel, inform ATSI. Requests concerning unauthorized transactions will be analyzed in cooperation with the payment processor and the issuing bank, in accordance with the applicable procedures.
7. Protection of personal data
ATSI processes the personal data provided through the Platform, the registration forms, communications with Users, and the payment flows, in accordance with the applicable legislation and with the Privacy Policy published on the Platform. Depending on the context, the data may include first name, last name, contact details, position, company, team data, logistical information, and data necessary to identify a payment.
Payment data is processed through NETOPIA Payments to the extent necessary to process the transaction. ATSI does not request or store full card data. For details on the purposes of processing, the legal bases, the recipients, the storage periods, and the rights of data subjects, the User must consult the Privacy Policy available on the Platform.
8. Intellectual property rights
The Platform’s content - including, without limitation, the texts, photographs, images, video materials, graphic elements, logos, databases, names, and informational materials - belongs to ATSI and/or its partners and is protected by the legislation on copyright, trademarks, and other intellectual property rights.
The User may consult and download the content exclusively for personal, non-commercial, and informative use. It is prohibited to copy, distribute, adapt, publish, commercially exploit, or use the content for any other purpose without the prior written consent of ATSI or the relevant rights holder.
9. Liability, safety, and limitations
ATSI makes reasonable efforts to ensure that the information published on the Platform is correct and up to date, but does not guarantee that the Platform will be permanently available, free of errors, or suitable for a particular need of the User. ATSI may update, restrict, or temporarily interrupt certain functionalities when necessary for maintenance, security, or updating the content.
Participants in sporting Events assume the risks inherent in practicing sport and have the obligation to comply with the eligibility conditions, medical recommendations, safety rules, and the Organizer’s instructions. Participants must ensure that their state of health allows the physical effort involved. The provisions of the specific Regulations regarding safety, conduct, medical assistance, and liability apply as a priority.
No provision of the Terms excludes or limits ATSI’s liability in situations where it cannot be excluded or limited by law. In other situations, ATSI is not liable for indirect damages, loss of data, loss of profit, or consequences resulting from the improper use of the Platform or the failure to comply with the Organizer’s instructions.
10. Third-party sites and services
The Platform may include links to third-party sites or services, including the payment processor, social networks, partners, and Event venues. These sites and services have their own policies and terms of use. ATSI does not control and assumes no responsibility for their content, availability, security, or policies.
11. Modification of the Terms
ATSI may periodically update the Terms to reflect legislative, operational, technical, or Event-organization changes. The updated version will be published on the Platform, indicating the date of the last update. For registrations already confirmed, changes that significantly affect the Participant’s rights or obligations will be communicated by reasonable means, when necessary.
12. Applicable law and dispute resolution
The Terms are governed by Romanian law. Any disagreement will be addressed as a priority amicably, through a request sent to [email protected]. If an amicable settlement is not possible, the dispute will be settled by the competent courts under Romanian law.
